By enrolling in the Favor Premium Loyalty Program (“Favor Premium” or the “Program”), you agree that the terms, conditions, limitations, and requirements below will apply (“Program Terms”) in addition to the current Terms of Service and Privacy Policy. Any terms not defined herein shall have the meanings set forth in the Terms of Service. In the event of any conflict, these Program Terms shall govern. 

 

1. Disclaimer

Favor Premium is currently in the pilot phase and being tested. Therefore the Benefits, Qualifying Activity, or other aspects or features may vary among participants and are subject to change. At the moment, participation is limited to invitation only, chosen randomly, and invitations are non-transferable.

We reserve the right to terminate any account or revoke participation in the Program or any Benefits if we believe, in our sole discretion, that any applicable terms have been violated.

2. General

Favor Premium is an unlockable loyalty program requiring the completion of select activities and criteria to unlock (the “Qualifying Activity”). Once the Qualifying Activity is completed, the Program grants you access to certain benefits as defined below (“Benefits”) on eligible orders placed through the Favor Service for eligible Merchants (as indicated by a Favor Premium icon) which may require a minimum subtotal (excluding taxes, fees, and tips) as indicated on the Favor Service. 

3. Benefits

Benefits include:

• $0 delivery fees on eligible merchants marked with the Favor Premium icon. 
• Special offers just for members, as indicated on the Favor Service or a promo.
• Additional rewards and experiences to be announced in the future.

We reserve the right to change whether a Merchant is eligible for the Program at any time with or without notice. Favor orders are subject to delivery driver and geographic availability. Taxes may apply to the cost of the items you order and/or to fees charged. Service fees, minimum gratuity, and other fees may apply.

4. Qualifying Activity

There is currently no program fee, participation in the Program is unlocked by completing the Qualifying Activity. The current Qualifying Activity is making 2 completed and paid orders within a 30-day qualification period, but this may change from time to time at Favor’s discretion.

5. Cancellation

You may cancel your free participation at any time in the app. You will cease receiving Benefits immediately.

6. Miscellaneous

Participation in the Program cannot be transferred or assigned. Sharing of Program Benefits outside of your household is prohibited. Age-restricted product delivery is only available from select partners indicated as 21+ in the Favor Service, as may be updated from time to time, and subject to any additional restrictions indicated there or elsewhere by Favor. In order to facilitate deliveries from H-E-B and/or to improve the products and services offered by Favor or H-E-B, LP (“H-E-B”), you hereby authorize us to share your order, account, and customer information with H-E-B. You acknowledge that participation in the Program is at your own risk and hereby agree to release, indemnify, defend, and hold harmless Favor, H-E-B, and their affiliates, employees, and representatives from and against any claims arising out of or relating to the Program or your participation therein. The maximum liability of Favor and/or H-E-B relating to a Program shall be $50 in the aggregate.

7. Modification & Termination by Favor

Favor may change the Program, the Qualifying Activity, Benefits, or other applicable terms or features at any time with or without notice. Favor reserves the right to terminate the Program at any time with or without notice in its sole discretion without any liability whatsoever.
