By enrolling in the Favor Gold Subscription (“Favor Gold” or the “Subscription”), you agree that the terms, conditions, limitations, and requirements below will apply (“Subscription Terms”) in addition to the current Terms of Service and Privacy Policy. Any terms not defined herein shall have the meanings set forth in the Terms of Service. In the event of any conflict, these Subscription Terms shall govern.

Disclaimer

We reserve the right to terminate any account or revoke participation in the Subscription or any Benefits if we believe, in our sole discretion, that any applicable terms have been violated.

General

Favor Gold is an automatically renewing subscription requiring recurring payments until canceled. A subscription grants you access to certain benefits as defined below (“Benefits”) on eligible orders placed through the Favor Service for eligible Merchants (as indicated by a Favor Gold icon) which may require a minimum subtotal (excluding taxes, fees, and gratuity) as indicated on the Favor Service.

Benefits

Benefits include:

• Unlimited $0 delivery fees on eligible merchants marked with the Favor Gold icon, subject to applicable minimum subtotal. .
• Monthly H-E-B coupons, currently $10 off purchases of $50 or more (valid for in-store or home delivery purchases) but subject to change.
• Reduced services fees on eligible merchants marked with the Favor Gold icon, subject to applicable minimum subtotal. 
• Additional offers on select locally owned restaurants.
• Birthday rewards, including order credit or exclusive offers, valid your birthday month.
• Special offers just for members, as indicated on the Favor Service or a promo.
• Additional rewards and experiences which may be announced in the future.

We reserve the right to change whether a Merchant is eligible for the Subscription at any time with or without notice. Favor orders are subject to delivery driver and geographic availability. Taxes may apply to the cost of the items you order and/or to fees charged. Service fees, minimum gratuity, and other fees may apply. You acknowledge that you are purchasing a Subscription exclusively from Good Vibes LLC.

$10 H-E-B coupon

The $10 H-E-B coupon is limited to one per customer and valid on purchases of $50 or more before taxes in-store or online at heb.com only. It cannot be combined with other offers and does not apply to gift cards, tobacco, alcohol, prescriptions, gasoline, Business Center, or any H-E-B merchants in the Favor app. The coupon is valid from the first day of the month received to the last day of the same month. You must link your H-E-B account 1 day prior to the first of the month to qualify for the coupon.

Subscription Fee

The current subscription fee is $9.99 (“Subscription Fee”) for one calendar month (“Subscription Period”), which is payable on the monthly anniversary of the date you enrolled. There is currently no yearly option, which may be provided in the future.

By signing up for Favor Gold, you agree that: (i) you will be charged your first Favor Gold subscription fee and any applicable taxes (such as sales tax, use tax, goods and services tax, and other transaction taxes) on the date you purchase your Favor Gold subscription; (ii) you authorize Favor and its service providers to store your payment method for the purpose of executing future Favor Premium auto-renewal transactions; (iii) UNLESS YOU CANCEL, BY DEFAULT (AND WITH PRIOR NOTICE ONLY TO THE EXTENT REQUIRED BY APPLICABLE LAW), YOUR FAVOR GOLD SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF THE THEN-CURRENT SUBSCRIPTION PERIOD; and (iv) AT THE TIME OF RENEWAL, FAVOR WILL AUTOMATICALLY CHARGE THE THEN-CURRENT SUBSCRIPTION FEE AND ANY APPLICABLE TAXES TO AN ELIGIBLE PAYMENT METHOD THAT WE HAVE ON FILE FOR YOU. If your payment details change, your card provider may provide us with updated payment details. We may use these new details or details from other payment methods on file in order to help prevent any interruption to your Favor Gold subscription. This includes our right to charge any payment method on file if your initial form of preferred payment fails. It is your responsibility to keep your billing information up to date. If any Subscription Fee is not paid in a timely manner or your transaction cannot be processed, we reserve the right to suspend, disable, cancel, or terminate your access to the Favor Service or your Favor Gold subscription. You will be responsible for paying all past due amounts. No Benefits will be provided if the Subscription Fee has not been paid or if the Subscription Period has expired. 

Free Trial

Free trials may be provided to select customers for the time period indicated in a promotion, typically 30 days but may vary (“Trial Period”). May not apply to existing or previous Subscription members, or any other exclusions as indicated on a promo. You may cancel anytime in the app. UNLESS YOU CANCEL BEFORE THE END OF THE TRIAL PERIOD, BY DEFAULT (AND WITH PRIOR NOTICE ONLY TO THE EXTENT REQUIRED BY APPLICABLE LAW), YOUR FAVOR GOLD SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF THE TRIAL PERIOD AND AT THE TIME OF RENEWAL FAVOR WILL AUTOMATICALLY CHARGE THE THEN-CURRENT SUBSCRIPTION FEE AND ANY APPLICABLE TAXES TO AN ELIGIBLE PAYMENT METHOD THAT WE HAVE ON FILE FOR YOU.

Cancellation

When you cancel a Favor Gold subscription, you cancel only future charges associated with your Favor Gold subscription. You may initiate your cancellation at any time through the Favor Service, but the cancellation will become effective at the end of your current subscription period. Instructions on how to cancel are available here. You must cancel at least one (1) day before the next-scheduled subscription renewal date to avoid being charged for the next subscription period (for example, if the renewal date is January 30, you must cancel by 11:59:59 p.m. on January 29). 

If you cancel your Favor Gold subscription within the first 48 hours of your first subscription period and have not placed a Favor Gold-eligible order during that period, Favor may, in its sole discretion, refund your Subscription Fee. If we issue a refund, credit, or discount, we are under no obligation to issue the same or similar refund in the future.

YOUR SUBSCRIPTION FEE IS NONREFUNDABLE and if you cancel your Favor Gold subscription, you will not receive a refund, but you can continue to enjoy the Favor Gold Benefits through the end of your then-current subscription period.

Miscellaneous

A Subscription cannot be transferred or assigned. Sharing of Program Benefits outside of your household is prohibited. Age-restricted product delivery is only available from select merchants indicated as 21+ in the Favor Service, as may be updated from time to time, and subject to any additional restrictions indicated there or elsewhere by Favor. In order to facilitate deliveries from H-E-B and/or to improve the products and services offered by Favor or H-E-B, LP (“H-E-B”), you hereby authorize us to share your order, account, and customer information with H-E-B. You acknowledge that participation in the Subscription is at your own risk and hereby agree to release, indemnify, defend, and hold harmless Favor, H-E-B, and their affiliates, employees, and representatives from and against any claims arising out of or relating to the Subscription or your participation therein. The maximum liability of Favor and/or H-E-B relating to a Subscription shall be $50 in the aggregate.

Modification & Termination by Favor

Favor may change the Subscription, the Subscription Fee, Benefits, or other applicable terms or features at any time with or without notice, provided that notice of any changes to the Subscription Fee shall be given via email no less than 30 days prior to taking effect. Favor reserves the right to terminate the Subscription at any time with or without notice in its sole discretion without any liability whatsoever, provided however that if an active Subscription is terminated by Favor (other than for violation of any applicable terms) then Favor will issue a refund of your subscription fee on a pro rata basis based on the amount of time remaining on your pre-paid subscription.
